Sailing Regulations, Participation Conditions and Cancellation Policy - 2026-2027 SEA4SOUL Flotillas

SEA4SOUL thanks you and welcomes you to one of our maritime activities.

 

1. General and Definitions

1.1 The website www.sea4soul.club (hereinafter: the "Website") is operated by SEA4SOUL (hereinafter: the "Operator"). 1.2 "The Activity" – A flotilla, Sea Time voyage, yoga retreat, or individual yacht charter, as specified in the booking form. 1.3 "The Participant" – Any person registering for the Activity and/or signing this form. 1.4 The Activity is defined as a "Remote Sale Transaction" and is regulated under the Consumer Protection Law, 5741-1981 (hereinafter: the "Law").

 

2. Registration and Payment

2.1 Registration for the Activity shall be completed only upon receipt of a down payment and written confirmation from the Company. 2.2 The remaining balance shall be paid no later than 60 days prior to the departure date for international activities. Failure to comply with the payment schedule shall be deemed a cancellation by the Participant, and cancellation fees shall apply as detailed below.

 

3. Cancellation Policy and Changes

The cancellation policy reflects the Company's obligations toward overseas charter providers. The client must notify the Company of any cancellation via email to: roneni@sea4soul.club.

3.1 International Voyages and Flotillas:

  • Cancellation more than 60 days before departure: Full refund minus a handling fee of 150 ILS or 5% (the lower of the two) per participant.

  • Cancellation between 60 and 30 days before departure: Cancellation fee of 50% of the total transaction value.

  • Cancellation less than 30 days before departure: Full cancellation fee (100%). No refund shall be granted.

3.2 Local Voyages (Israel): Cancellation up to 72 hours before the scheduled time minus 100 ILS/5%. Cancellation less than 48 hours prior – full charge.

3.3 All cancellations must be made in writing via email. The determining date shall be the start of the next business day following receipt of the document. "Business Days" are counted according to workdays in Israel (Sunday through Thursday, 09:00–17:00), excluding holidays, holiday eves, or official days of rest. 3.4 The day of the cancellation notice and the day of departure shall not be included in the calculation of cancellation periods. 3.5 Special Populations: In accordance with Section 14C1 of the Law, senior citizens, new immigrants (Olim), and persons with disabilities are entitled to cancel the transaction within 4 months of the transaction date, provided the engagement included a conversation with a representative. 3.6 Name Changes: Replacing a participant's name is subject to Company approval and a handling fee of €50, subject to the charter company's approval.

 

4. Minimum Participants and Proactive Cancellation

4.1 The Activity (Flotilla/Themed Voyage) is subject to a recommended minimum number of participants: two boats or 12 people for Flotillas/Themed Voyages, and 6 people for Sea Time voyages. 4.2 The Company shall notify the Participant of cancellation due to insufficient registration up to 30 days before departure. In such a case, the Participant will receive a full refund of the amount paid, without further compensation. 4.3 The Company reserves the right to cancel or change the itinerary due to Force Majeure, hazardous weather conditions, or instructions from port authorities.

 

5. Specific Provisions for Sea Time Voyages (International Water Skipper)

5.1 The Company undertakes to provide a certified Skipper (Skipper 60) who will sign the Sea Time certification as required by the Administration of Shipping and Ports (RCP). 5.2 The responsibility for holding a valid Skipper 30 license for at least one year and a passport photocopy with entry/exit stamps rests solely with the Participant. 5.3 The accumulation of Sea Time (8 days/4 consecutive days) is contingent upon meeting professional duties (night watches, navigation, etc.).

 

6. Specific Provisions for Flotillas

6.1 Command of the Vessel and Cabin Allocation: There are two possible sailing tracks:

  • 6.1.1 Professional Skipper on behalf of the Company:

    • Accommodations: The Skipper shall be allocated a private cabin for their exclusive use (or a designated skipper cabin in the bow). Guests may not be housed in this cabin.

    • Responsibility: The Skipper bears professional and legal responsibility and is the supreme authority at sea.

    • Provisions: The Skipper's expenses are fully covered by the crew's "Common Kitty."

    • Rest Hours: While the Skipper is available for emergencies 24/7, their rest and sleep hours must be respected to ensure maritime safety.

    • Cleaning and Maintenance: The Skipper is responsible for operating the yacht and its systems. They are not responsible for interior cleaning, dishwashing, or tidying guest cabins.

  • 6.1.2 Participating Skipper (Bareboat): If a participant is the certified skipper of the yacht, they are the legally responsible party toward the charter company and local authorities. They must hold all required licenses (Skipper 30/60, GMDSS, etc.). Responsibility for the Check-in and Check-out procedures with the charter company rests solely with the Participating Skipper.

6.2 Cook / Hostess Clause:

  • 6.2.1 Role Definition: The Cook is responsible for menu planning, provisioning (funded by guests), meal preparation, and galley management. If the role includes Hostess duties, responsibility extends to cleaning common areas (salon and deck).

  • 6.2.2 Service: Includes preparation of 2 meals a day (breakfast and lunch) plus snacks. Dinners are typically held ashore. Galley cleanup after meals is the sole responsibility of the Cook.

  • 6.2.3 Provisions and Accommodations: The same rules as the Skipper apply regarding private accommodations and coverage of expenses via the Common Kitty.

 

7. The Yachts

  • Yachts are monohulls or catamarans (42-52 ft) based on registration numbers or client choice.

  • Equipped with a SUP and a dinghy with an outboard motor for water activities.

  • Fully equipped galley. Some yachts include an espresso machine.

  • Participants receive a pillow, pillowcase, blanket, sheet, and one towel for the week. Extra linens are available for a fee.

  • No washing machines on board; participants should pack accordingly.

  • Itinerary and schedules are proposals only and may change due to weather, sea conditions, or port availability.

  • The final night (Friday) will be at the starting marina. Checkout is Saturday by 09:00 AM.

Yoga Voyages and Health Declaration: 7.1 The Participant declares they are in fit physical and mental condition for yoga and prolonged stays at sea. 7.2 A health declaration form must be completed upon registration.

 

8. Operating Expenses ("Common Kitty")

8.1 Definition: Participants of each yacht shall establish a cash "Kitty" on embarkation day to cover direct operating costs. 8.2 Estimated Costs: Between €250 to €350 per person, managed independently by the crew members (not the Company or Skipper). 8.3 Included: Basic food (breakfast/lunch), water, cleaning supplies, fuel for the main engine and dinghy, port fees, electricity, and the Skipper's provisions. 8.4 Not Included: Dinners at tavernas, alcohol, cigarettes, personal consumption, and shore excursions/car rentals.

 

9. Equipment, Safety, and Responsibility

9.1 Absolute prohibition on prohibited substances, weapons, or dangerous equipment. 9.2 Participants must obey the Skipper/Flotilla Manager regarding safety and maritime law. 9.3 Swimming is permitted only with the Skipper's approval.

 

10. Insurance

10.1 The yacht is covered by Third-Party and Hull insurance as per industry standards. 10.2 Mandatory: The Participant must independently purchase international travel insurance including coverage for Extreme Sports (Sailing) and Trip Cancellation/Curtailment. The Company is not liable for personal injury or property damage not covered by the yacht's insurance.

 

11. Price Exclusions

Prices do not include: Airfare, transfers, personal travel insurance, personal expenses, dinners/drinks, tips, and shore-side rentals (cars/bikes).

 

12. Additional Clauses

  • Organizers reserve the right to replace instructors or skippers in case of illness.

  • Participants are responsible for flight requirements and entry/exit regulations.

  • Security Event/War: In the event of cancellation due to security/war, the vacation will be postponed; no refunds will be issued.

  • Passport: Must be valid for at least 6 months from the date of travel.

  • Media Consent: Participants authorize the use of photos taken during the trip for promotional purposes on social media and the Website.

 

13. Jurisdiction

Exclusive jurisdiction for any matter arising from this agreement shall lie with the competent courts in the District of Tel Aviv.

 

14. Waiver of Liability

It has been explained to me and I understand that the Flotilla leaders are not responsible for any damage caused during the Flotilla, and I hereby waive in advance any claims of any kind or type.
